Often, when couples with debt get divorced, they will often wonder whether the divorce will show up on their credit report and how it will impact their credit score. A Los Angeles divorce attorney from Zitser Family Law Group, APC is here to help clarify. Please continue reading and reach out to our experienced legal team to learn more about whether your divorce will show up on your credit report and what you can do to become debt-free. Here are some of the questions you may have:
Will my divorce show up on my credit report?
In short, the answer is no–your marital status is irrelevant when it comes to your credit report. That being said, if you have any joint credit accounts with your spouse, there is a strong chance that you will both be on the hook for any debt racked up on that account.
What can I do to protect myself from my ex’s credit card debt after a divorce?
Fortunately, there are ways to prevent yourself from being saddled with your ex’s credit card debt. To start, and perhaps the easiest way to do so, is by closing the account entirely, or, at the very least, having your name removed from the account so it is solely in your ex’s name. If you can do this, there is a good chance you will no longer be responsible for paying off this debt. Though you can address who is responsible for paying off certain debts in your divorce decree, your decree does not have the final say with creditors. Therefore, even if your divorce decree states that your spouse is in charge of certain accounts and is to pay off those debts, if he or she doesn’t do so and both of your names are still on the account, you will both be equally responsible for making these payments. This is why it is simply best to either close an account completely or have only one person named on the account. If you have any further questions or you believe you are unfairly saddled with your ex-spouse’s debt, please do not hesitate to pick up the phone and give us a call today. We are here to help.
