As the COVID-19 pandemic fell upon us, we all knew we were in uncharted waters, in essentially all aspects of our lives. Most of us never had to bunker down, stay home from work, and only leave the house when necessary for months on end before, and as a result, many couples, both married and unmarried, realized that they can no longer stay with their partners. That being said, of course, divorcing during COVID-19 has presented us with many highly unique challenges. This has been the case throughout the United States, and California is no exception.
While many spouses feel trapped in a relationship, other spouses feel the opposite, for various reasons. Unfortunately, in cases of domestic violence, which were on the rise in many parts of the country at different stages of this pandemic, many spouses felt isolated and trapped with their aggressor, and courts had to act quickly to accommodate those individuals and open for certain critical cases such as those involving domestic violence, even at a time where they were closed for most other legal cases.
In other scenarios, many people feel as though a pandemic is the worst time to get divorced, in large part due to very practical concerns, such as “where will I live when everyone is bunkering down?” while at the same time, many other spouses are taking advantage of online and telephone mediation/divorce, through services such as Zoom.
One of the most challenging aspects of getting divorced while simultaneously having to bunker down is, of course, living together while hashing out your divorce. If you find yourself in this situation, you should do everything in your power to create a non-confrontational environment. For example, you and your spouse can each primarily stay in certain portions of your house to largely avoid contact, and thereby avoid conflict. In the best-case scenario, however, you can both simply acknowledge the fact that though you disagree on many issues, as long as you are under the same roof, it is best for you and your kids if you remain as amicable as possible.
